Educate Yourself<\/p>\n
Before you seek legal action against your executor, it\u2019s always a good idea to know the ins and outs of your estate. Depending on the estate\u2019s limitations and what the court decides, you could wait to receive your inheritance for months or years.<\/p>\n
If the executor doesn\u2019t pay outstanding debts and file tax returns for the estate before distributing inheritances, they could be held personally liable. It may not be the executor\u2019s fault that you haven\u2019t received your payment yet if creditors or the IRS delays the process of making these payments.<\/p>\n
Talk To Your Executor<\/p>\n
Having a respectful talk with your executor is always a good idea before turning to the courts. If you\u2019ve tried peaceful remediation with your executor already, you may have a stronger case to present if or when you do turn to a probate court.<\/p>\n
As a general rule, a court won\u2019t remove an executor without seeing a serious reason to act. If the executor has been inattentive, that alone may not be a strong enough reason in the court\u2019s eyes.<\/p>\n

They\u2019ve wasted assets or illegally stolen from the estate<\/p>\n<\/li>\n
They\u2019ve been convicted of a felony since becoming executor<\/p>\n<\/li>\n<\/ul>\n
Legal Options<\/p>\n
If all else fails and you must take legal action, it\u2019s up to you and the courts to set things right. You have two options:<\/p>\n
Petition the court<\/p>\n<\/li>\n
File a civil suit<\/p>\n<\/li>\n<\/ul>\n
A court petition may be a good option if you have proof that the executor has been neglecting their duties. The court will hold a hearing and allow both you and the executor to present a case. If the court finds that there is enough evidence to replace the executor, they will do so.<\/p>\n
Filing a civil lawsuit may be a better option if you can show that the executor\u2019s actions (or inaction) have negatively impacted you. If their misuse or irresponsible distribution of funds has caused financial impact or burden, providing evidence to the court helps your case. With this method, you may be able to reach a mutual settlement before things move to the courtroom itself.<\/p>\n
