Part One"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">Meeting the Two Part Test to Qualify for Workers\u2019 Compensation Benefits\u2014Injuries Suffered on a Work Break<\/h3>\n\n\n\n<p>In the aftermath of a&nbsp;<a href=\"https:\/\/www.edwardleelaw.com\/personal-injury\/workers-compensation\/\">workplace injury<\/a>, you may have the right to collect workers\u2019 compensation benefits for your disability, as well as reimbursement or payment of medical expenses tied to your injury. In New Jersey, as in most states, there are only two requirements to qualify for workers\u2019 compensation: you must show that you suffered an injury and you must demonstrate that it was work-related.<\/p>\n\n\n\n<p>When you\u2019ve been hurt in a traumatic accident on the job, meeting those tests can be relatively straightforward. With a repetitive stress or motion injury, it becomes a bit more of a challenge. There are, though, certain situations where it may be unclear whether you were \u201con the job.\u201d This series of blogs looks at some of those uncertain instances.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-full\"><img decoding=\"async\" width=\"300\" height=\"200\" data-src=\"https:\/\/epicdevsite.info\/2023-EdwardLeeLaw\/wp-content\/uploads\/2023\/10\/Injury-Work-Related.jpeg\" alt=\"\" class=\"wp-image-970 lazyload\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 300px; --smush-placeholder-aspect-ratio: 300\/200;\" \/><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Injuries Suffered on a Break<\/h3>\n\n\n\n<p>Under certain labor laws, workers have a right to take regular breaks, including time away from the desk or assembly line for meals. Technically, when you are sitting in the break room or cafeteria, you\u2019re not doing what you get paid to do. Does that mean you can\u2019t recover workers\u2019 compensation benefits if you are injured while on break? As a general rule, it does not\u2014regularly scheduled breaks constitute a part of your work and you can customarily seek and receive workers\u2019 compensation benefits for injuries suffered in the company break or lunch room.<\/p>\n\n\n\n<p>As with most rules, though, there are exceptions. You may be prevented from recovering workers\u2019 compensation benefits if you were engaged in horseplay at the time of the injury or doing something that was contrary to established company policy. In addition, if you leave company premises while on break, you typically cannot seek workers\u2019 compensation benefits for injuries incurred, unless you had a work purpose for leaving the grounds. For example, if your supervisor sends you to get food for other employees or to drop off a package at the post office, you will probably be eligible for workers\u2019 compensation for injuries suffered on the way there or back.
