Different courts have the capacity to hear different types of disputes, but there is some overlap. You\u2019ll want an experienced attorney to help you determine the best place to file your lawsuit and to ensure that the court has proper \u201cjurisdiction\u201d over your dispute.<\/p>\n\n\n\n<p>You must also file your complaint in a timely manner. The amount of time you have will be determined by a written law known as the \u201cstatute of limitations.\u201d This will vary based on the type of dispute, so you\u2019ll need knowledgeable counsel to ensure that you comply with the law.<\/p>\n\n\n\n<p>Once your complaint has been filed and properly served on all other parties, the parties you are suing (the \u201cdefendants\u201d) will have a specific amount of time to file an answer to the complaint.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Step Two \u2014 The Discovery Phase<\/h2>\n\n\n\n<p>If you file a complaint and the defendant fails to file an answer, you may be able to ask the court for a default judgment in your favor.<\/p>\n\n\n\n<p>If, however, the defendant files an answer within the time period allowed, the court will then schedule a meeting to establish a schedule and inform the parties of any \u201cdiscovery\u201d rules. Don\u2019t be surprised if the judge also makes a concerted effort to get you to settle your dispute. Most court dockets are full and any lawsuit that can be prematurely resolved lightens the load.<\/p>\n\n\n\n<p>Discovery is simply a legal term for the gathering of evidence. Typically, discovery takes three forms\u2014depositions, interrogatories and requests for production:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>At a deposition, all parties have the opportunity to question a witness. A court reporter is present and takes down all questions and answers. Because the proceeding does not take place in court, typical rules of evidence don\u2019t apply. For example, a witness may give testimony at a deposition that would be excluded at trial as hearsay.<\/li>\n\n\n\n<li>With interrogatories, the parties submit written questions to each other. The court will typically limit the number of interrogatories and will require that they be returned within a specific period of time.<\/li>\n\n\n\n<li>Requests for production typically apply to documents, but may also apply to any other physical evidence.<\/li>\n<\/ul>\n\n\n\n<p>In the American civil system, the concept of \u201copen discovery\u201d applies. That means that both sides have an equal right to knowledge of and access to all relevant evidence.
