All disorderly persons offenses in New Jersey are within the jurisdiction of the municipal courts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How Municipal Court Proceedings Work<\/h3>\n\n\n\n<p>If you\u2019re ticketed or arrested and charged with a disorderly persons offense, you\u2019ll receive notice of the date for a mandatory court appearance. You must attend this hearing; if you don\u2019t, a bench warrant can be issued for your arrest.<\/p>\n\n\n\n<p>At the hearing, the judge will notify you of all charges against you, read you a statement of your rights, explain the procedures the court will follow, and give you plea options:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>You can choose to plead guilty<\/em>\u2014If you do, the court may determine your sentence immediately, provided the judge believes that you understand what you\u2019re pleading to, as well as the potential consequences.<\/li>\n\n\n\n<li><em>You can choose to plead not guilty<\/em>\u2014You can ask the court to either conduct a trial immediately or delay proceedings so you can prepare for trial. This delay is commonly referred to as an \u201cadjournment.\u201d<\/li>\n<\/ul>\n\n\n\n<p>If you plead not guilty and get an adjournment, the court is likely to set a trial date, but you may have other hearings before your case gets to trial, including motions to determine the admissibility of certain types of evidence.<\/p>\n\n\n\n<p>New Jersey municipal courts do not have jury trials. The judge takes all testimony, considers all evidence, and makes a ruling. The prosecutor has the burden of proof to demonstrate your culpability beyond a reasonable doubt. You can testify on your own behalf but are not required to.
