Most personal injury lawsuits are based on allegations of negligence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Negligence?<\/h2>\n\n\n\n<p>To successfully prove negligence in court, you must show three things:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>that the defendant (person from whom you seek compensation) breached the standard of care by not acting reasonably under the circumstances,<\/li>\n\n\n\n<li>that the breach of the standard of care caused an accident or injury, and<\/li>\n\n\n\n<li>that you suffered actual losses as a result of the accident or injury.<\/li>\n<\/ul>\n\n\n\n<p>In most&nbsp;<a href=\"https:\/\/www.edwardleelaw.com\/personal-injury\/\">personal injury<\/a>&nbsp;claims, the standard of care is that of a reasonable person under the circumstances. The law doesn\u2019t give much more guidance, simply identifying a reasonable person as \u201can ordinary person of average prudence.\u201d The standard of care is different, however, in claims alleging medical malpractice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is the Standard of Care in a Medical Malpractice Lawsuit?<\/h2>\n\n\n\n<p>Medical professionals, because of their specialized training, and because of the trust that society puts in them, are expected to adhere to a higher standard of care. As the law has evolved in New Jersey, a doctor or nurse must provide the same level of care as that provided:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>by a reasonably competent and skilled healthcare professional,<\/li>\n\n\n\n<li>with similar training, background, and experience,<\/li>\n\n\n\n<li>under the same circumstances, and<\/li>\n\n\n\n<li>in the same medical community.<\/li>\n<\/ul>\n\n\n\n<p>Jurors are not, however, expected to know what the standard of care is for a particular medical professional.
